Opening the case yesterday, Pat Butler SC, for the council, said his client was frustrated with Shell's attitude. The company has been dragging its feet over the matter, he said. The council's contractor had been unable to work on the site and Shell should have to pay the consequential costs on foot of the principle that the "polluter pays". more »

Ms Justice Mary Laffoy was also told by Lord Dan Brennan QC, for two local residents who object to the pipeline, that the Minister for the Marine may decide within the next few weeks that the gas pipeline should operate at normal pressure and not at the high level of pressure originally proposed by Shell E&P Ireland. Such a decision would represent a victory for his clients on one of the issues in the case, given Shell's denial that the high-pressure pipeline posed any risk, counsel said. more »

It is an over simplification to say that what occurred in Rossport was the basic failure of Shell to get its position across in a credible fashion and the equally significant failure of those leading the protesters to listen. It is clear from the reaction of the protesters to the report published this week that the report makes very little difference. Shell appear to have accepted this by indicating a willingness to look at re-routing the pipeline. more »

The latest stage in the legal action takes place in the High Court tomorrow, but the company said yesterday it did not anticipate a full hearing until the autumn. Talks chaired by Peter Cassells are expected to continue this week between the company and the five men jailed over their opposition to the pipeline. more »

Shell E&P Ireland has ruled out an offshore processing platform for the Corrib gas field. Managing director Andy Pyle said in Castlebar, Co Mayo, yesterday that an offshore terminal had been discounted previously for good reasons involving safety, environmental and technical matters. On Thursday, he had said Shell was willing to discuss all options with the north Mayo community, including the offshore option. more »

Dr Mark Garavan, spokesman for the five men, said there was "general and genuine relief" at the High Court president's decision not to punish the five further over their contempt of court - for which they spent 94 days in jail. However, the core issues relating to the pipeline project still had to be addressed, he said, and serious safety issues remained. more »

However, he awarded costs of the contempt proceedings against them to Shell E&P Ireland. He also warned that, should the men "again physically prevent Shell E&P exercising its rights" and if a further injunction was obtained against them, the court had jurisdiction to impose a penalty of a further fixed term of imprisonment of "an appropriate duration". In June 2005, Shell issued a motion for attachment and committal of the five for contempt of the April 4th court order. On June 29th, 2005, the five men were jailed until they purged their contempt. The men refused to do so but they were released from prison in September 2005 after Shell applied to have the April injunction discharged. more »

Significantly, the proposed terms include a commitment by both parties that "all developments, concepts and all routes should be considered in the mediation and that the parties may set down core non-negotiable issues". Shell has previously said it will not change the basic plan for an onshore terminal, linked to the Corrib gas field 70km offshore by a high-pressure pipeline. The five men and the Shell to Sea campaign have been calling for an offshore terminal for the project. more »
